Driver Terms of Service

Additional terms specific to independent drivers on the CURBZ platform.

Last revised: September 16, 2026

This Driver Agreement ("Agreement") is a binding contract between you ("Driver," "you," or "Contractor") and CURBZ ("CURBZ," "we," "us," or "our") governing your access to and use of the CURBZ platform to find and complete delivery jobs. By creating a driver account, accepting a job, or otherwise using the CURBZ driver app or website, you agree: (a) to engage CURBZ to provide the services described below; (b) to comply with this Agreement; and (c) that you have read, understand, and agree to the general Terms of Service and Privacy Policy, each of which is incorporated into this Agreement by reference. If this Agreement conflicts with the general Terms of Service or Privacy Policy, this Agreement governs with respect to that conflict.

1. The CURBZ platform

CURBZ operates a web and mobile marketplace that connects independent drivers with customers and businesses who need same-day delivery, courier, and hauling services (each a "Delivery" or "Job"). CURBZ makes commercially reasonable efforts to provide the following to Drivers:

  • Job matching. CURBZ will notify you of available Jobs in your operating area and vehicle class, which you may accept, decline, or ignore at your sole discretion.
  • Profile listing. CURBZ may display your first name, vehicle type, and rating to customers so they can identify who is completing their Job.
  • Payment processing. CURBZ provides the billing and payout infrastructure (including our Stripe-powered payment partner) used to collect customer payment and remit your earnings.
  • Customer support. CURBZ will field customer questions, complaints, and refund requests related to a Job, and will communicate with you as needed to resolve them.
  • Account administration. CURBZ provides the technology, dashboards, and notifications needed for you to manage your availability, vehicles, and earnings.

CURBZ reserves the right to suspend or deactivate your account for violating this Agreement, our Community Guidelines, or our Anti-Discrimination Policy.

2. What CURBZ does not provide

CURBZ's services relate only to the matching, billing, and support functions described above. CURBZ does not pick up, transport, load, unload, or deliver any goods. You are solely responsible for your own vehicle, equipment, licensing, training, and any other requirement needed to safely complete a Job. CURBZ is not responsible for injuries, property damage, traffic incidents, or any other liability arising from the pickup, transport, or delivery services you perform. CURBZ has no control over your schedule, time off, or how you choose to perform your work, subject to the safety and conduct standards described in this Agreement.

3. Eligibility & your responsibilities

To remain active on the platform you must provide CURBZ with a current driver's license, vehicle registration, proof of insurance, and any other documentation or professional certification we reasonably request to verify your identity and eligibility. You must immediately notify CURBZ of any change to your license, registration, insurance, or background-check status. You represent that:

  • You are at least 18 years of age;
  • You hold a valid driver's license and are legally authorized to operate the vehicle(s) you use for Jobs;
  • You own or have the legal right to operate any vehicle you use for Jobs, and maintain all legally required registration and insurance for it;
  • You are free to enter into this Agreement and are not restricted, contractually or otherwise, from doing so; and
  • You will keep your vehicle in safe operating condition through regular inspection and maintenance, and will immediately stop accepting Jobs if your vehicle is no longer safe to operate.

All information you provide to CURBZ must be accurate and kept up to date. Failure to do so may result in suspension or removal from the platform.

4. Jobs, payment & payout

Accepting a Job. When you accept a Job, you agree to update its status through the driver app (en route, arrived, picked up, delivered) so CURBZ and the customer can track progress. A Job is complete once you have safely delivered the cargo and confirmed completion in the app. CURBZ is not responsible for anything you do after a Job is marked complete.

Payout. Customers pay a fee calculated by the CURBZ platform based on the details of their request (the "Delivery Fee"). Your payout is a percentage of the Delivery Fee, or a flat base-plus-mileage guarantee, whichever is greater, as shown on the Job before you accept it, plus 100% of any tip the customer adds. CURBZ retains the remaining portion of the Delivery Fee as our service fee. Payouts are issued to the bank account you connect through our payments partner once a Job is marked delivered and, where applicable, approved by CURBZ.

Expenses. Except as otherwise agreed in writing, you are responsible for your own expenses (fuel, tolls, vehicle upkeep, etc.) incurred while completing Jobs.

Cancellations & no-shows. Repeatedly cancelling accepted Jobs or failing to show up as scheduled may result in temporary suspension, monetary penalties, or permanent deactivation of your account, at CURBZ's discretion.

Payment disputes. If a customer disputes that a Job was completed or disputes its cost, CURBZ may temporarily withhold your payout pending investigation. If CURBZ determines the fees were accurate, we will attempt to collect from the customer; if a customer refuses to pay after a Job is verifiably completed, CURBZ will still pay you the amount owed, subject to standard proof-of-delivery requirements.

5. Vehicle & safety standards

As an independent driver, you agree to maintain your vehicle in a condition suitable for the safe transport of cargo, including regular inspections and timely repairs. You must follow the Safe Driving Policy and any applicable hazardous-materials restrictions described in our Hazmat Policy at all times while completing Jobs. Failure to maintain your vehicle or follow safety standards may result in suspension or deactivation, and you assume all responsibility for damage to cargo or delays caused by your failure to do so.

6. Representations, warranties & indemnity

You represent and warrant that you will not, under any circumstances, transport any item in violation of local, state, or federal law, and that you will not discriminate against or harass any customer, merchant, or CURBZ representative on any basis prohibited by our Anti-Discrimination Policy or applicable law. You are solely responsible for any liability arising from your operation of a vehicle during a Job, including personal injury, property damage, or death, and you agree to indemnify and hold CURBZ harmless from any claim, loss, or damage arising from your performance of Jobs, your breach of this Agreement, or your negligent, reckless, or intentional misconduct.

7. Confidentiality

In the course of using the CURBZ platform you may receive information about our business, customers, pricing, or technology that is not publicly available ("Confidential Information"). You agree to keep Confidential Information private, use it only to perform Jobs and operate your CURBZ account, and not disclose it to any third party without our prior written consent. This obligation does not apply to information that is or becomes publicly available through no fault of yours, or that you are required to disclose under a valid legal order (in which case you will give CURBZ prompt notice before disclosing).

8. Independent contractor relationship

You are an independent contractor, not an employee, partner, or agent of CURBZ. Nothing in this Agreement, and nothing about your use of the platform, creates an employment, partnership, joint-venture, or agency relationship between you and CURBZ. You set your own schedule, choose which Jobs to accept, and supply your own vehicle, tools, and equipment. You are solely responsible for any tax withholding or reporting related to amounts paid to you, and you are not eligible for CURBZ employee benefits of any kind, including health insurance, workers' compensation, or unemployment insurance.

9. Limitation of liability

To the fullest extent permitted by law, CURBZ's total liability to you under this Agreement is limited to the service fees CURBZ has retained from your completed Jobs in the three (3) months preceding the claim.

10. Term & termination

This Agreement begins on the date you first accept a Job through the CURBZ platform and continues on a month-to-month basis until terminated. Either you or CURBZ may terminate this Agreement at any time, with or without cause, by giving notice to the other party. Sections 6 through 9 and any payment obligations that accrued before termination will survive termination.

11. Changes to this Agreement

CURBZ may update this Agreement from time to time. Continuing to accept Jobs after an update is posted constitutes acceptance of the revised terms. Material changes will be communicated through the driver app or by email where practical.

12. Dispute resolution

Any dispute arising out of or relating to this Agreement or your use of the CURBZ platform will first be addressed through good-faith negotiation between you and CURBZ. If a dispute cannot be resolved informally, it will be resolved under the dispute-resolution provisions of our general Terms of Service.

13. General

  • Entire agreement. This Agreement, together with the Terms of Service and Privacy Policy, is the entire agreement between you and CURBZ regarding your work as a driver, and supersedes any prior discussions or agreements on the subject.
  • Assignment. You may not assign this Agreement without CURBZ's prior written consent. CURBZ may assign this Agreement without your consent.
  • Severability. If any part of this Agreement is found unenforceable, the remaining provisions remain in full effect.
  • No waiver. CURBZ's failure to enforce any part of this Agreement is not a waiver of its right to do so later.
  • Headings. Section headings are for convenience only and do not affect interpretation of this Agreement.
